Terms of Service

Welcome to SermonBuild. These Terms of Service (“Terms”) govern your access to and use of the SermonBuild website, application, and services (collectively, the “Service”) operated by SermonBuild (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years of age to use SermonBuild. By using the Service, you represent that you meet this requirement and that the information you provide during registration is accurate and complete.

2. Account Registration and Security

  • You must provide accurate and complete information when creating your account, including your name, email address, and phone number.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You must notify us immediately if you become aware of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. The Service

SermonBuild is a sermon preparation and management platform designed for pastors and church leaders. The Service includes:

  • A rich text editor for writing and formatting sermons
  • AI-powered tools for sermon analysis, text enhancement, summarization, translation, study question generation, and image creation
  • Sermon organization through series, collections, and scheduling
  • Export capabilities (PDF, Word, slides, ProPresenter)
  • Sharing features for sermons, study pages, and series
  • Offline draft support and automatic cloud backup
  • A presentation mode for delivering sermons

4. Free Trial

  • New accounts receive a 14-day free trial with full access to all features.
  • The trial begins automatically on the date your account is created.
  • No payment information is required to start a trial.
  • After the trial period expires, access to premium features will be restricted until you subscribe to a paid plan.
  • We reserve the right to modify or discontinue the free trial at any time.

5. Subscription Plans and Pricing

5.1 Plans

SermonBuild offers a premium subscription plan (“SermonBuild Pro”) with monthly and annual billing options. Current pricing is displayed on our website and within the application at the time of purchase.

5.2 Billing

  • All payments are processed securely through Stripe.
  • Subscriptions are billed in advance on a recurring basis (monthly or annually) based on the plan you select.
  • By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
  • All prices are listed in U.S. dollars (USD) unless otherwise stated.

5.3 Promotional and Founders Pricing

From time to time, we may offer promotional or introductory pricing. Promotional pricing is subject to the terms stated at the time of the offer, including any expiration dates. Founders pricing, when available, is locked in for the lifetime of your continuous subscription.

5.4 Price Changes

We reserve the right to change our subscription prices. If we change prices for your plan, we will provide at least 30 days’ notice before the new price takes effect. Your continued use of the Service after the price change constitutes your agreement to the new price.

6. Cancellation and Refunds

6.1 Cancellation

  • You may cancel your subscription at any time through the Subscription settings within your account or via the Stripe customer portal.
  • Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.
  • After cancellation takes effect, your account will revert to limited access. Your sermon content will be preserved and remain accessible.

6.2 Refunds

  • Subscription fees are generally non-refundable.
  • If you believe you were charged in error or have extenuating circumstances, please contact us at admin@sermonbuild.com and we will review your request on a case-by-case basis.
  • Refunds, if granted, will be processed through Stripe to your original payment method.

7. Your Content

7.1 Ownership

You retain full ownership of all content you create, upload, or store on SermonBuild, including sermons, notes, media files, and any other materials (“Your Content”). We do not claim any ownership rights over Your Content.

7.2 License to Us

By using the Service, you grant us a limited, non-exclusive license to store, process, display, and transmit Your Content solely for the purpose of providing and improving the Service. This includes:

  • Storing your sermons in our database and backup systems
  • Sending portions of your content to AI providers when you use AI features
  • Making your content accessible via shared links when you choose to share
  • Generating exports (PDF, Word, slides) from your content

This license ends when you delete Your Content or your account.

7.3 Your Responsibilities

You are solely responsible for Your Content. You represent and warrant that:

  • You have the right to use and share any content you upload or create on the platform
  • Your Content does not infringe the intellectual property rights of any third party
  • Your Content does not violate any applicable law or regulation

8. AI-Generated Content

  • SermonBuild uses third-party AI services (including OpenAI, Anthropic, and Google) to power certain features such as sermon analysis, text enhancement, summarization, translation, study questions, and image generation.
  • AI-generated content is provided as a starting point and tool for your ministry. It is not a substitute for your own theological study, prayer, and discernment.
  • We do not guarantee the accuracy, completeness, or theological correctness of AI-generated content. You are responsible for reviewing and editing all AI-generated content before using it.
  • AI features may be subject to rate limits, availability, or changes based on our third-party providers.

9. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or the rights of others
  • Upload or distribute malware, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Use the Service for any purpose other than sermon preparation, ministry support, and related church activities
  • Share content that is hateful, threatening, or promotes violence
  • Resell, redistribute, or sublicense the Service without our written permission
  • Scrape, data-mine, or use automated systems to access the Service in a manner that exceeds reasonable use
  • Circumvent or attempt to circumvent subscription restrictions or feature limitations

10. Sharing and Public Content

  • When you share a sermon, study page, or series, the content becomes accessible to anyone with the shared link.
  • You are responsible for the content you choose to share publicly.
  • Shared links can be revoked at any time, which removes public access.
  • We are not responsible for how others use content you have shared publicly.

11. Intellectual Property

11.1 Our Property

The Service, including its design, code, features, branding, logos, and documentation, is owned by SermonBuild and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

11.2 Feedback

If you provide us with suggestions, feedback, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

12. Third-Party Services

The Service integrates with third-party services including Supabase, Stripe, SendGrid, OpenAI, Anthropic, and Google. Your use of these services through SermonBuild is also subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

13. Availability and Modifications

  • We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation.
  • We may perform scheduled or emergency maintenance that temporarily affects availability.
  • We reserve the right to modify, update, or discontinue any feature of the Service at any time. If we discontinue a significant feature, we will provide reasonable notice.
  • We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the application. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Data and Backups

  • We perform regular backups of our systems, but we are not responsible for the loss of Your Content due to circumstances beyond our reasonable control.
  • We strongly encourage you to regularly export your sermons using the PDF or Word export features as an additional backup.
  • Offline draft storage is provided as a convenience and may not capture all changes in all circumstances.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • AI-generated content will be accurate, complete, or theologically sound
  • Any errors in the Service will be corrected

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERMONBUILD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF MINISTRY OPPORTUNITIES, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

17. Indemnification

You agree to indemnify and hold harmless SermonBuild and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of any third-party rights

18. Account Termination

18.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion, all your data will be permanently removed as described in our Privacy Policy.

18.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment method fails and cannot be resolved
  • We are required to do so by law
  • We reasonably believe your account is being used fraudulently or in a manner that could harm other users or the Service

If we terminate your account for a reason other than a Terms violation, we will provide reasonable notice and an opportunity to export your data before deletion.

19. Governing Law and Disputes

  • These Terms are governed by the laws of the United States, without regard to conflict of law principles.
  • Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation.
  • If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are located in a jurisdiction that provides you with a right to bring claims in court, in which case that right is preserved.
  • You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SermonBuild regarding the Service and supersede all prior agreements or communications.
