Terms of Service — SermonBuild

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SermonBuild ("SermonBuild," "we," "us," or "our") governing your access to and use of the SermonBuild platform, including the web application at app.sermonbuild.com and the marketing site at sermonbuild.com (collectively, the "Service").

By registering for an account or using any part of the Service, you confirm that you are at least 18 years old, have the authority to enter into this agreement, and accept these Terms in full.

2. Account Registration

To access SermonBuild, you must create an account using a valid email address. You are responsible for:

Providing accurate and complete registration information
Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately at admin@sermonbuild.com if you suspect unauthorized access

You may not share your account with others or create multiple accounts for the purpose of circumventing limits or policies.

3. Subscription and Billing

Free Trial: New accounts may receive a free trial period as advertised at the time of signup. No credit card is required during the trial. At the end of the trial, continued access requires a paid subscription.

Paid Plans: SermonBuild offers monthly and annual subscription plans. Current pricing is displayed at sermonbuild.com/#pricing. Prices are listed in US dollars and are subject to change with advance notice.

Founders Pricing: During limited promotional periods, we may offer locked-in Founders Pricing. If you subscribe during a Founders Pricing promotion, your rate will be locked for the lifetime of your continuous subscription. Canceling and resubscribing forfeits the locked rate.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) until canceled. You authorize us to charge your payment method on file via Stripe at the start of each renewal period.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide prorated refunds for unused time within a billing period.

Refunds: All sales are final. We do not issue refunds except where required by applicable law or at our sole discretion in cases of documented billing errors.

Payment Processing: Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service. We do not store your payment card details.

4. Acceptable Use

You agree to use SermonBuild only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service to generate, distribute, or store content that is illegal, defamatory, harassing, hateful, or violent
Attempt to reverse-engineer, scrape, or extract data from the platform in an unauthorized manner
Use automated bots or scripts to access the Service in ways that place unreasonable load on our infrastructure
Circumvent any security measures, access controls, or usage limits
Impersonate another person or misrepresent your identity or affiliation
Resell, sublicense, or otherwise commercialize access to the Service without our written consent
Use AI-generated outputs to plagiarize or misrepresent the work of others

We reserve the right to suspend or terminate accounts that violate these standards without prior notice.

5. Your Content and Intellectual Property

Your Content: Sermons, notes, outlines, series, and any other content you create in SermonBuild ("Your Content") remain your intellectual property. We do not claim ownership of Your Content.

License to SermonBuild: By storing Your Content on our platform, you grant SermonBuild a limited, non-exclusive license to host, store, and display Your Content solely for the purpose of providing the Service to you. We do not use Your Content for marketing without your explicit consent.

SermonBuild IP: The SermonBuild platform — including its design, code, branding, AI prompting systems, and features — is owned by SermonBuild and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written permission.

6. AI-Generated Content

SermonBuild uses OpenAI's API to generate sermon outlines, writing suggestions, theological commentary, study questions, and other content. You acknowledge that:

AI-generated content is provided as a tool and starting point — it is not a substitute for your own theological study, discernment, and pastoral judgment
You are responsible for reviewing, verifying, and taking ownership of any AI-generated content before preaching or publishing it
AI outputs may occasionally be inaccurate, incomplete, or theologically imprecise — always verify scripture references and theological claims
You own AI-generated content produced within your account and bear responsibility for how it is used

7. Content Sharing Features

SermonBuild includes features that allow you to share sermons, study guides, and series with members of your congregation or the public via unique links. When you create a public share link:

The shared content becomes accessible to any person with that link
You are responsible for the content you choose to share
You may revoke shared links at any time through your account settings

SermonBuild does not independently review shared content and is not responsible for how shared links are distributed or used.

8. Service Availability

We strive to maintain a reliable and available service, but we do not guarantee uninterrupted access. SermonBuild may experience downtime for maintenance, updates, or reasons beyond our control. We are not liable for any losses arising from service interruptions.

We reserve the right to modify, suspend, or discontinue features of the Service at any time, with reasonable notice where practicable.

9. Termination

By You: You may close your account at any time by contacting us at admin@sermonbuild.com. Upon account deletion, your data will be removed per our Privacy Policy.

By Us: We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Where feasible, we will provide notice and an opportunity to export your content before termination. No refund will be issued for the remaining subscription period upon termination for cause.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SERMONBUILD DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE FROM HARMFUL COMPONENTS.

SERMONBUILD IS A PRODUCTIVITY TOOL. IT DOES NOT PROVIDE THEOLOGICAL CERTIFICATION, PASTORAL CREDENTIALS, OR DOCTRINAL AUTHORITY. AI-GENERATED CONTENT SHOULD BE EVALUATED WITH PASTORAL WISDOM AND PROPER HERMENEUTICAL DISCIPLINE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERMONBUILD AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SERMONBUILD IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold SermonBuild harmless from any claims, losses, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered under the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial or class action.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
